Wedding Photography Terms & Conditions
This agreement is between Lisa Cowen Photography (the “Photographer”) and the clients detailed in the accompanying booking form (the “Client”). By ticking the agreement box on the booking portal, the Client agrees to be bound by the following terms of business.
1. Securing the Date & Payments
- The Booking Deposit: A non-refundable booking retainer of £150 is required to officially secure the Photographer’s services for the specified wedding date. Until the retainer is cleared and the booking form is submitted, the date remains open to other inquiries.
- The Final Balance: The remaining balance of the chosen collection must be paid strictly 6 weeks to the wedding date. If payment is not received by this deadline, the Photographer reserves the right to cease all services and cancel the booking, with all prior payments forfeited.
2. Cancellation & Postponement
- Cancellation by the Client: In the event of a cancellation by the Client, notice must be given in writing. The £150 retainer is entirely non-refundable. If cancellation occurs within 60 days of the wedding date, the full outstanding balance remains due.
- Postponement: If the Client changes the wedding date, the Photographer will make every effort to accommodate the new date, subject to availability. A date-transfer fee may apply. If the Photographer is already booked on the new date, the booking will be treated as a cancellation by the Client.
3. Creative License & Coverage
- Artistic Interpretation: The Client grants the Photographer full artistic license regarding the style, composition, posing, and editing of the images. The Photographer will make every effort to honor specific request lists but cannot guarantee any specific shot due to the fluid nature of a live wedding day.
- Exclusivity: Lisa Cowen Photography shall be the exclusive professional photographer retained for the event.
4. Copyright & Digital Use License
- Copyright Ownership: The copyright of all images created remains strictly and permanently with Lisa Cowen Photography, in accordance with the UK Copyright, Designs and Patents Act 1988.
- Client Usage License: The Client is granted a lifetime, personal-use license to download, print, share online, and display the final edited images. The Client may not sell the images, use them for commercial profit, or apply personal filters/alterations to the final edited files.
5. Delivery & Storage
- Image Culling: The Photographer will curate and edit only the best images that represent her professional standards. Raw or unedited files will not be delivered under any circumstances.
- Delivery Timeline: The final digital gallery will be delivered within 4 weeks of the wedding date (this may vary slightly during peak summer season).
- Archive Guarantee: It is the Client’s responsibility to download and permanently secure their copies upon receiving the gallery.
6. Working Conditions & Meals
- Meals: For all collections extending past 6 hours of coverage, the Client kindly agrees to provide the Photographer with a meal. This is usually served while the guests are eating the wedding breakfast, during which no photography takes place.
- Cooperation & Conduct: The Photographer requires the cooperation of the wedding guests and venue staff to perform her duties effectively. The Photographer reserves the right to cease filming/photography if subjected to aggressive, abusive, or inappropriate behavior from anyone at the event.
7. Limitation of Liability
- Unforeseen Circumstances: In the highly unlikely event that the Photographer is unable to attend due to severe illness, injury, or an act of God, a trusted and vetted professional associate photographer of equal caliber will be supplied to capture the day. If no replacement can be found, liability is limited entirely to a full refund of all monies paid by the Client.
- Technical Failure: While extreme care and industrial-grade equipment backups are used, liability for any partial or total loss of images due to electronic failure, memory card corruption, or theft is limited to a full refund of monies paid relative to that portion of coverage.
Agreement: Ticking the confirmation box on the secure booking form constitutes full acceptance of these terms and forms a legally binding contract under English law.
